Guatire Hosting Terms of Service and Acceptable Use

This document outlines the terms and conditions governing the provision of all our Web Hosting, Reseller Hosting, VPS, and Dedicated Server services.

1. Acceptance of the Terms

By purchasing or using any product or service from Guatire Hosting, you (the Client) agree to these Terms of Service in their entirety. These terms govern all current and future services and may be modified at any time by the company, with or without prior notice, which the user accepts by continuing to use our services.

2. Responsibilities of Guatire Hosting

2.1. Technical Support and Warranty (Not Managed)

Guatire Hosting Technical support will be provided exclusively via ticket or email, focusing solely on issues related to server hardware, network, and connectivity. The client is responsible for the administration, security, operation, and backups of their software, operating system, and content.

2.2. Service Guarantee

We guarantee 99.9% uptime (online time) for our network. However, we do not guarantee that the service offered will be free from interruptions or errors beyond our control, nor that the available information will be free of viruses. The Client is aware of the inherent risks of using technology.

2.3. Pricing Policy

The company reserves the right to modify the price of its products or services at any time, whether it is the value to acquire a new service or for its renewal, with or without prior notice to its customers.

3. Customer Responsibilities

3.1. Acceptable Use of Services (AUP)

The customer agrees to use the products only for lawful purposes. The use of our resources for, but not limited to, the following is strictly prohibited:

• Sending unsolicited bulk email (SPAM).
• Hosting copyrighted material without authorization (piracy).
• Hosting, distributing, or linking to illegal, fraudulent, child pornography, or content that promotes violence/hate.
• Performing distributed denial-of-service (DDoS) attacks or any action that damages our servers or other customers' networks.

Failure to comply with the AUP will be sufficient grounds for immediate termination of services without prior notice.

3.2. Identification and Behavior

The client guarantees that they are a legally responsible person (over 18 years of age or with legal authorization). The client agrees to keep their data (email, name, phone number) accurate and up-to-date. Any disrespectful conduct, mistreatment, or threats toward the company or its employees will be grounds for immediate termination of service.

3.3. Suspension, Termination and Refund

• Suspension for Non-Payment: Failure to pay before the due date will result in immediate suspension. The company reserves 72 hours to remove the suspended product information.

3.4. Refund (Product-Specific Policy)

The right to a refund only applies to the following services: Shared Hosting, Email, and Reseller Hosting. The customer will receive a refund only if the service has not been satisfactorily delivered 72 hours after the ticket is submitted, payment is made, and the order is confirmed.
Exceptions: Dedicated infrastructure services such as Dedicated Servers and VPS (Virtual Servers), as well as registered domains, are non-refundable once the product has been delivered, configured, and the customer has received their access credentials. Purchasing these products implies acceptance of the non-applicability of refunds.
• Cancellation Notification: If you wish to cancel, you must formally notify us with a cancellation request.

3.5. Indemnification

The client agrees to defend, indemnify, and hold harmless Guatire Hosting, its employees, and suppliers from any and all claims, damages, or legal liabilities (including attorneys' fees) arising from the client's use of the services, including any illegal content, copyright infringement, or violation of the AUP.

3.6. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the Bolivarian Republic of Venezuela. You agree to submit to the jurisdiction of the competent courts of Venezuela for the resolution of any legal conflict or dispute arising from these terms or your use of our services.

Guatire Hosting is committed to complying with applicable data protection regulations, including the principles of the Venezuelan Infogovernment Law and the data management standards of the GDPR (General Data Protection Regulation) of the European Union, for clients with an international reach.

4. Domain Registration Provisions

4.1. Acquisition and Modification

Guatire Hosting does not control domain name availability. Any transcription errors or changes of mind are the client's responsibility; the registered domain cannot be modified until the contract ends.

4.2. Legality and Cancellation

Registration does not guarantee the legality of domain use. The client is responsible for ensuring that their domain use does not violate any company or international entity regulations. The client accepts that the domain may be canceled or suspended by ICANN or government entities for the purpose of resolving intellectual property disputes or claims.

Final Note: If the client does not accept these Terms of Service and Acceptable Use, Guatire Hosting reserves the right to refuse to provide the service. Please refrain from purchasing if you do not agree with these policies.
